After a person dies, in many situations their estate must go through the probate court in order for it to be distributed to the deceased's heirs.  Probate includes (1) the validation in court that a person's will is legitimate and the governing document for the estate; (2) gathering the deceased's property; (3) arranging for the appraisal of any property that must be valued; (4) paying off all debts and taxes; and (5) the final distribution and transfer of the property as stated by the will or governing state law if there is no will.
